Justice Abhijit Ganguly Vs. Justice Soumen Sen in Kolkata High Court : The Supreme court held a special proceeding on Saturday to give an end to Justice Abhijit Ganguly Vs. Justice Soumen Sen conflict in Kolkata high court. A constitution bench of five-judges of the Supreme court with Chief Justice of India DY Chandrachud with justices BR Gavai, Aniruddha Bose, Sanjiv Khanna and Surya Kant today stayed the proceedings before the Calcutta high court in the medical admission case.

The supreme court stayed the order of Justice Abhijit Ganguly, the CBI probe into medical admission in West Bengal. The bench has issued a notice today to the original petitioner and the government of West Bengal. At the initial stage, Justice Abhijit Ganguly said that he has no faith in state police and ordered for CBI probe in the matter on Wednesday. The supreme court will hear the matter on Monday (29th January 2024) and stayed all proceedings in Calcutta High Court in the medical admission case.

The five-judge bench of the Supreme Court was hearing a suo muto case that arised for passing an order by Justice Abhijit Ganguly by ignoring a division bench order. The conflict between Justice Abhijit Ganguly Vs. Justice Soumen Sen started from here. On 24th January during hearing in medical admission case, justice Abhijit Ganguly ordered for CBI probe and asked Bengal police to hand over documents to CBI for further investigation.

Within an hour of passing the order by the single-judge bench, the advocate general Kishore Dutta plead before the division bench of justice Soumen Sen and Uday Kumar to get a stay order and the division bench stayed justice Abhijit Ganguly’s order. On the same day, justice Abhijit Ganguly ordered the advocate general to handover the case file to CBI for investigation even after the stay order was passed by the division bench.

The next morning (25th January 2024), the division bench passed the stay order of the CBI investigation in the case. But the matter took an unexpected turn from here. Justice Ganguly questioned the basis of the stay and asked to ignore the order of the division bench. He even asked CBI (Central Bureau Investigation) to commence the investigation immediately and alleged that justice Soumen Sen had called another justice of Calcutta High Court, Ms. Amrita Sinha to his chamber in recent past and told her not to disturb TMC MP Abhishek Bannerjee since he has a potential political future. A special constitution bench sits on Saturday holiday for an emergency hearing to give an end to this conflict.
